Terms and Conditions of Sale

These General Terms and Conditions of Sale define the rights and obligations of Laboratoire International de diffusion and its consumers regarding the online sale of products offered on the website: www.softcondoms.com

Any order for a product from the site's online store implies prior review and acceptance of these General Terms and Conditions of Sale.

1 - Terms of Offers

We reserve the right to adapt or modify these General Terms and Conditions of Sale at any time.

The items for sale in the Shop are presented and detailed so that every consumer can be aware of the essential characteristics of the products they wish to purchase (Article L 111-1 of the Consumer Code).

The photos illustrating the product descriptions are for informational purposes only and are not contractual. We reserve the right to add/modify/delete any item from our catalog at any time.

2 - Contract

We confirm the acceptance of the customer's order by sending an email to the address they provided. The sale will only be concluded upon order confirmation.

This confirmation will be considered an invoice and will contain the following information:

  • Product designation
  • Details of the order (type, price, and quantity of items ordered, total amount of the order including VAT, and delivery costs).
  • Order date
  • Order number
  • Delivery address
  • Customer’s identity and contact details.

We reserve the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.

The information provided by the buyer when placing an order is binding: in case of an error in the recipient's contact details, we cannot be held responsible for the inability to deliver the products.

All orders placed by individuals are for their personal use; individuals are prohibited from any partial or total resale of the products.

3 - Prices

Prices are expressed in Euros, All Taxes Included (T.T.C), and do not include shipping costs.

We reserve the right to revise these prices at any time but undertake to apply the rates in force at the time of the order, subject to the availability of the ordered products on that date.

4 - Shipping Costs

For all shipments, the shipping cost amount appears before any payment of the order. Goods are shipped by La Poste, without insurance, via So Colissimo – Pickup or Colissimo Domicile, without signature, according to the option chosen by the buyer.

5 - Payment

Payment is due immediately on the order date.

You can pay for your order using the following methods:

  • PayPal
  • Bank transfer
  • Check
  • Postal money order

In the case of payment by bank transfer, the amount of your order is debited immediately by the banking institution.

Payment by bank check is only possible for checks in Euros drawn on a bank domiciled in France.

The check must be made payable to L.I.D. Payments by check and postal money order must be sent to the address below: LABORATOIRE INTERNATIONAL DE DIFFUSION – L.I.D. SOFT 68 boulevard Carnot 06400 CANNES - France.

The delivered goods will remain our property until all obligations to us are fulfilled, and specifically until full payment of the price, including any accrued interest.

6 - Order Shipment - Deliveries - Claims

Packages are generally shipped within 48 hours of payment receipt and from the 1st business day following the order, subject to stock availability.

In case of stock unavailability, we will inform you of the necessary shipping times for your order. If this period exceeds 15 days, the customer has the right to cancel their order and request a refund. Delivery times of 2 business days are indicative and do not constitute a commitment or guarantee.

All our orders are packaged in hermetically sealed, sturdy packaging that does not reveal any indication of the contents.

A shipping tracking number will be provided to the customer as soon as their package is taken over by the carrier.

The customer must check the condition of the package upon arrival before accepting it. If the package appears sufficiently damaged or deteriorated that the products it contains could be harmed, the customer must report it to the delivery person and refuse it. Only under this condition can we handle the incident in the best possible way.

If the customer does not take this step and unconditionally accepts a package that was nevertheless damaged during transit, we cannot be held responsible for its replacement or any compensation. This check upon arrival is therefore very important for the customer, even if the probability of this type of deterioration remains extremely low.

Are considered as cases of force majeure discharging the seller from its obligation to deliver: war, riot, fire, strikes, accidents, and the impossibility for Laboratoire International de Diffusion to be supplied.

7 - Right of Withdrawal

Should you not be satisfied with your order, you have a period of 14 days from the date of receipt to exercise your right of withdrawal by sending us a letter. You then have a further 14 days to return the merchandise to us. As stipulated by law, and for reasons of hygiene and health protection, only merchandise in its original condition (unopened cases and cellophane, unpackaged individual products) and unused is eligible for withdrawal.

We undertake to refund the full amount of the item(s) concerned upon their receipt by our services, with return shipping costs remaining at your expense.

8 - Refund

In case of a refund accepted by our Customer Service by phone (cost of a local call) or email, you will receive the due amount within 15 days of registration and, according to your choice, by check or bank transfer (in which case, you must have previously provided us with your bank details).

9 - Retention of Title

In accordance with Law No. 80.335 of May 12, 1980, the delivered goods remain the property of Laboratoire International de Diffusion until full payment of their price.

10 - Data Protection Provisions

The information requested from you via the order form is necessary for processing and executing your order. In accordance with the Data Protection Act of January 6, 1978, you have the right to access and rectify information concerning you.

11 - Disputes

These General Terms and Conditions of Sale are governed by French Law. Any dispute relating to the interpretation or execution of orders will be examined with the utmost care and will be subject to an immediate amicable proposal. In case of an unresolved dispute between Laboratoire International de Diffusion and the customer, only the Commercial Court of Cannes will have jurisdiction to settle the dispute.
